TENANTED LAND VESTS WITH GOVERNMENT AS ON 01-03-1974

Sakrappa vs State Of Karnataka ILR 1985 KAR 1833 If it is tenanted land immediately before 1-3-1974 but the tenant is not in possession immediately before 1-3-1974, such land also vests in the State Government, according to the decision of the Full Bench of this Court. So, it is immaterial whether he makes an application or not before 30-6-1979. This land also goes to the State pool under Section 77. If he makes an application within time but cannot be registered as an occupant of lands excluded under Section 45(2), those lands go to the pool for disposal under Section 77 and he is liable for eviction from such lands.
